Arkasa Server - Terms of Sale

Important Legal Notice
These Terms of Sale are SEPARATE from and IN ADDITION TO our Terms of Service. These Terms of Sale specifically govern purchases of paid services, premium features, VIP access, subscriptions, and in-game items.
By completing a purchase, you enter into a legally binding sales contract with Didier De Ridder, trading as Arkasa, governed by Belgian law and EU consumer protection regulations.
Value Added Tax (BTW/VAT) Compliance
VAT Registration: Didier De Ridder, trading as Arkasa, is registered for Belgian Value Added Tax.

VAT Rate: All digital services sold to customers in Belgium are subject to 21% VAT.
EU Cross-Border Sales: For customers in other EU member states, VAT is charged at the rate applicable to your location using the EU One Stop Shop (OSS) mechanism.
Price Transparency: The price you see is the price you pay. VAT is already inside it and is never added on top at checkout. Buyers outside the EU pay no EU VAT, so their invoice shows none.
If you need a VAT breakdown for your own accounting, email arkasaserver@gmail.com with your transaction ID and we will provide it.
Invoicing: An invoice is generated for every purchase and is available through the shop. It carries an invoice number, the date, what you bought, the amount paid, and our name and VAT number as the seller. If anything you need for your own accounting is missing from it, email arkasaserver@gmail.com with your transaction ID and we will issue a corrected one. We keep our copies for 10 years, as Belgian tax law requires.

Nature of These Purchases
Purchases support the operation and maintenance of the Arkasa server cluster. Arkasa is an independently operated, unofficial ARK community and is not affiliated with or endorsed by Studio Wildcard.
These are purchases of digital services, not donations. You pay a stated price and receive a stated service in return, and the consumer rights in these Terms apply in full.
Services Offered
We offer paid digital services for Arkasa Server including:
- Monthly subscription packs (Starter, Supporter, Champion, Elite, Legend)
- One-time purchase packs and starter kits
- In-game items, dinosaurs, and resources
- Temporary boosts (XP, harvesting, taming, weight)
- Boss kits and special items
- Gift cards, where you choose the value (see Article 6)

Most items are GUARANTEED - you receive exactly what is described. Some randomized content (loot boxes) may be available in regions where permitted. See Article 5 for details on our randomized content policy.

Payments are handled by Stripe and PayPal. Card details never reach us. Both are regulated payment providers and publish their own compliance information; we are not in a position to certify it on their behalf.
Delivery
Digital delivery via immediate account activation upon payment confirmation:

- In-game delivery/activation (instant)
- An invoice, generated automatically for every purchase — see Invoicing above
Total Cost: The price shown at checkout includes all taxes. No hidden fees.
Article 2: Right of Withdrawal (14-Day Cooling-Off Period)
Your Legal Right
Under EU Consumer Rights Directive 2011/83/EU Article 16(m) and Belgian consumer protection law, you have the right to withdraw from this purchase within 14 calendar days without giving any reason.
Withdrawal Period: Begins on the date your purchase is completed.
Loss of Withdrawal Right for Immediate Digital Delivery
Under Article 16(m) of the Consumer Rights Directive, the withdrawal right falls away for digital content delivered immediately only when two things are true:
- You expressly request that delivery begins before the 14 days are up, and
- You acknowledge that starting delivery costs you the withdrawal right.
The law requires both statements. It does not require two separate tick boxes, although separate boxes make it easier to show afterwards which one you agreed to.
Your express request, stated here
Because our checkout cannot capture the request separately, it is set out as a term of this contract. By completing a purchase you expressly request that we begin delivering it immediately, before the 14-day withdrawal period has expired, so that your items, VIP access or subscription are usable straight away rather than after a two-week wait.
If you would rather keep the full 14 days and wait for delivery, do not buy through the shop. Email arkasaserver@gmail.com instead and we will arrange it manually.
What our checkout actually shows
Purchases run through Tip4Serv. Its checkout presents a single combined tick box reading:
I agree to the Terms of Sale and Privacy Policy, and I lose my right of withdrawal or refund upon immediate access to the digital content after payment.
We cannot change that sentence or split it: the checkout belongs to Tip4Serv and its wording is not ours to configure.
Two things about that box you should know
It links to Tip4Serv's pages, not ours. In that sentence, "Terms of Sale" opens Tip4Serv's refund policy and "Privacy Policy" opens Tip4Serv's privacy policy. Those are not these documents. Ours are at www.arkasa.gg/terms-of-sale and www.arkasa.gg/privacy, linked from the footer of every page. We have asked Tip4Serv to point the links at them.
It says "refund", which is wider than what you actually give up. Read against these Terms, that means the 14-day withdrawal right described here and nothing else. It does not touch your statutory rights. In particular:
- If a purchase is not delivered, you are entitled to delivery or to your money back (Article 3).
- If it does not work as described, you are entitled to a fix, a price reduction, or a refund (Article 3).
- An unused gift card can still be refunded within 14 days (Article 6).
- If a cluster closes permanently, the unused part of a subscription is refunded (Article 4).
Which text wins
Tip4Serv's refund policy says all sales are final. That policy does not govern your purchase. Your contract is with us, not with Tip4Serv, and Tip4Serv acts as our payment and delivery platform — its own terms confirm that the seller stays responsible for the products and their delivery.
Where the two disagree, these Terms apply, in the version published at www.arkasa.gg/terms-of-sale on the day you bought. These Terms are the more generous of the two, and we do not rely on Tip4Serv's wording to refuse you anything.
Age
You must be at least 16 years old to make a purchase, matching the minimum age for the Server itself. If you are under 18, you must have permission from a parent or guardian. By completing a purchase you confirm that this is the case.
How to Exercise Withdrawal (If Applicable)
For a gift card, use the withdrawal function: www.arkasa.gg/withdraw. It is linked from the footer of every page and stays available throughout the withdrawal period. You give your name and the code, confirm on a separate step, and we email you a confirmation of receipt straight away. Keep that email: it records the date and time you withdrew, which is what proves you were inside the 14 days.
The gift card is the only purchase in our shop that has not been consumed by the time you change your mind, which is why it is the case that page handles. For anything else, see Article 2 above and Article 3 — a purchase that was not delivered or does not work is a different claim entirely, and it is not bound by 14 days.
You do not have to give a reason.

Processing:
- Confirmation within 48 hours
- Full refund within 14 calendar days
- Same payment method as original purchase
- No fees or deductions
Article 3: Consumer Rights for Digital Content
Conformity Guarantee
The digital services must conform to this contract:
Subjective Conformity:
- Services match descriptions in product pages
- Services possess advertised functionality and performance
- All promised features and benefits are provided
Objective Conformity:
- Services possess quality normal for digital services of this type
- Services are fit for purposes such services are normally used
- Services include necessary updates and bug fixes
If Service is Non-Conforming
Step 1 - We Fix It: If VIP access doesn't work, items don't deliver, or features malfunction, we must bring the service into conformity free of charge within a reasonable timeframe (typically 7-14 days).
Step 2 - If Fix Fails: If we cannot fix the problem, you have two remedies:
- Option A: Proportionate price reduction
- Option B: Contract termination with full refund (unless defect is minor)
Burden of Proof:
- Within 1 year: Defect is PRESUMED to have existed at purchase. We must prove otherwise.
- Subscriptions: We are responsible for ANY defect during the ENTIRE subscription period.
Your rights cannot be waived. Any term attempting to exclude these rights is VOID.
Article 4: Subscription Auto-Renewal and Cancellation

We offer monthly subscription packs with recurring billing:

Auto-Renewal Notice
All recurring subscriptions automatically renew each cycle unless you cancel first. Your renewal date, subscription tier, and price are visible at any time on your subscription page: https://arkasa.tip4serv.com/dashboard/my-subscriptions
We do not send a separate reminder email before each renewal. You may cancel at any time up to the renewal date, free of charge.
How to Cancel
Method 1 - Self-Service (Recommended):
- Go to https://arkasa.tip4serv.com/dashboard/my-subscriptions
- Sign in with the account you used to purchase
- Click the EYE button next to the subscription
- Click UNSUBSCRIBE and receive immediate confirmation
Paid with PayPal: you may also cancel the subscription directly from your PayPal account.
Checked out as a guest: you have no account to sign in to, so use Method 2 or Method 3 below and we will cancel it for you.

Cancellation Rights
- Cancel anytime with immediate effect
- No penalty or fee
- Access continues until end of current paid period
- No refund of the current billing period simply because you cancelled
- Unless the service was not delivered, did not work as described, or the cluster closed. Then Article 3 and Article 4 apply and you are refunded regardless of the cancellation
Why a Subscription Pack Cannot Be Withdrawn From
Cancelling and withdrawing are not the same thing. Cancelling stops the next renewal, and you keep what you already paid for. Withdrawing means asking for the money back inside 14 days — and for a subscription pack, that is not possible once it has been delivered.
A pack is not just a role and a discount. The moment you buy it, it hands you colour tokens, kits, points, lootbox contents and in-game items. Those are digital content supplied immediately at your express request, which is exactly the case where the withdrawal right falls away (Article 2). They are also spent, consumed and traded to other players within minutes, and we cannot take an item back out of somebody else's base.
This does not touch your other rights. If a pack is not delivered, or does not give you what the shop said it would, Article 3 applies in full: a fix, a price reduction or a refund, whenever it happened and regardless of the 14 days. That is a different claim, and you do not lose it.
If a cluster closes permanently while your subscription is running, the unused part of the period is still refunded — see above.
Cancelling must be as easy as subscribing, and Belgian law requires that. If you bought through the Tip4Serv dashboard, it is: two clicks on your subscription page. If you checked out as a guest with PayPal, there is no account to sign in to, so cancel from PayPal directly or send us one line by email or Discord and we do it for you. If that ever takes longer than subscribing did, tell us and we will fix it.
If a Cluster Closes Permanently
If we permanently close a cluster or the Server while your subscription is running, we will refund the unused part of the period you have already paid for, calculated pro rata, where consumer law requires it. We contact you at the email address on your order. You do not have to claim this separately.
Article 5: Guaranteed Items and Randomized Content Policy
Belgian Gaming Commission Compliance
Paid loot boxes with randomized outcomes constitute gambling under Belgian law and require a Gaming Commission license.
Our Policy
For Belgian customers: Products containing randomized content (such as loot boxes or mystery boxes) are NOT available for purchase. Belgian customers are geo-blocked from purchasing these items in compliance with Belgian gambling legislation.
For non-Belgian customers: Certain products with randomized content may be available. These are clearly marked in the shop and sold only to customers in jurisdictions where such sales are permitted.
Guaranteed Items
The majority of our products are GUARANTEED and NON-RANDOM:
- Subscription packs with clearly defined benefits
- Starter kits with specified contents
- Named dinosaurs and items
- Temporary boosts with exact effects
You receive exactly what is described on the product page.
Virtual Currency Transparency
If we offer in-game virtual currency:
- Real-world EUR price displayed prominently
- No confusing conversion rates
- Exact amount purchasing (no forced overpurchasing)
- Same consumer protections as EUR purchases

Geoblock Technical Implementation
Belgian customers are blocked from purchasing randomized content items through:
- IP-based verification: Geographic location determined by IP address
- Payment method validation: Country associated with payment method checked
- Account registration: Country declared at account registration verified
Technical Provider: Geoblock verification is implemented and enforced by our payment platform Tip4Serv. Tip4Serv maintains audit logs of geoblock enforcement including:
- Blocked purchase attempts by Belgian users
- Verification methods used
- Timestamp and transaction details
Gaming Commission Audit: Documentation available upon lawful request from Belgian Gaming Commission via Tip4Serv compliance records.
Article 6: Gift Cards
What You Are Buying
A gift card is store credit for the Arkasa shop, issued as a code. You choose the value at checkout — the price shown before you enter an amount is not the price you pay.
Validity and Expiry
Gift cards do not expire. The credit stays on the code until it is spent. There is no expiry date, no dormancy fee, and no reduction over time.
How It Is Used
- Redeem the code in the shop at checkout.
- If you spend less than the full value, the remainder stays on the code for a later purchase.
- Credit can only be spent in the Arkasa shop. It cannot be exchanged for cash or transferred to another payment method.
Transferability
A gift card is a code, not an account. Anyone holding the code can redeem it, which is what makes it usable as a gift. Treat the code like cash: we cannot block, reissue or refund a code that someone else has used, and we cannot tell you who used it.
Currency
Gift cards are issued in the currency you paid in. A card bought in one currency keeps that currency; it is not converted at redemption.
Refunds
An unused gift card can be withdrawn from within 14 calendar days of purchase, using www.arkasa.gg/withdraw. We check that the code still holds its full original value, then refund to the original payment method and void the code.
A partly used gift card. Spending part of the credit does not cancel the whole thing. What has been spent is delivered and cannot come back — but the untouched remainder still can, on request within the same 14 days. Email arkasaserver@gmail.com with the code. We refund whatever is left on it and void the code.
Once the credit is fully spent there is nothing left to refund.
This does not affect your rights under Article 3 if a gift card is not delivered or does not work.
Article 7: Payment Processing Security
Payment Processors
Payments are securely processed through:
- Tip4Serv - Payment platform (tip4serv.com)
- Stripe - Card payments
- PayPal - Alternative payment method
Each of these providers is responsible for its own regulatory compliance and publishes its own terms. By making a purchase, you also agree to Tip4Serv's Terms of Service.
Security
- All payment data is encrypted in transit
- We never receive or store your card details
- Card payments may ask you to confirm through your bank (3D Secure). Whether that step appears is decided by your bank and the payment provider, not by us: strong customer authentication has exceptions, so some payments go through without it
Transaction Records
Every payment is documented with:
- Unique transaction ID
- Date and timestamp
- Amount and currency
- Service/item purchased
- Payment method
- VAT invoice reference
Records retained 10 years for tax compliance.
Payment Disputes
Contact us (optional, usually the fastest route): Email arkasaserver@gmail.com with transaction ID and issue description. Response within 72 hours.
Consumer mediation (optional):

Court: You may bring proceedings before a competent court at any time. Neither step above is a precondition.
Chargebacks
Legitimate chargebacks (unauthorized transactions, non-delivery, or defective services) are your consumer right and will be handled in accordance with applicable law.
Fraudulent or abusive chargebacks (where goods were delivered as described and used) may result in:
- Suspension or termination of your account
- Revocation of access to virtual goods
- Us disputing the chargeback with evidence of delivery and usage
- Recovery of administrative costs and fees where permitted by law

Article 8: Personalized Pricing Disclosure
Belgian Law Requirement (2022 Amendment to Code of Economic Law)
Our Position: We do NOT use personalized pricing, dynamic pricing, or algorithmic price adjustments.
All customers see the same prices for the same products regardless of:
- Browsing history
- Purchase patterns
- Device type
- Time of day
- Geographic location (except for VAT rate differences)
- Demographic characteristics
Article 9: Consumer Complaints and Dispute Resolution
Internal Complaint Handling
Consumers may submit complaints by email to arkasaserver@gmail.com
- Subject: "Formal Complaint"
- Please include relevant account details, purchase information, and a clear description of the issue.
We aim to:
- Acknowledge receipt within a reasonable timeframe
- Provide a substantive response within a reasonable period
- Seek a good-faith resolution where reasonably possible
Alternative Dispute Resolution (ADR)
Participation in ADR is voluntary. It is never a condition for going to court.
Consumers in Belgium may bring a complaint to the Consumentenombudsdienst / Service de Médiation pour le Consommateur via https://consumentenombudsdienst.be. The service is free for consumers and either handles the complaint itself or refers it to the qualified body for the sector.
Consumers elsewhere in the EU/EEA may obtain information and assistance on a cross-border complaint from the network of European Consumer Centres, for example the European Consumer Centre Belgium via www.eccbelgium.be.
Court Proceedings
Nothing in this article limits a consumer's right to bring proceedings before a competent court in accordance with applicable law.
Article 10: Limitation of Liability

Disclaimer
We do not promise that the Server is always available, never loses data, or runs on every setup. It is a community cluster, not a service with guaranteed uptime.
What you bought is a different matter. The conformity guarantee in Article 3 applies in full: a purchase has to be delivered and has to work as described, and if it does not, you are entitled to a fix, a price reduction or a refund. Nothing in this article touches that.
Not Liable For
- Player-generated content or other players' conduct
- Loss of game progress, items, or virtual property due to server issues
- Indirect, consequential, or punitive damages
- Lost profits, revenue, or data
Liability Cap
This cap does not apply to consumers where Belgian or EU law does not allow it, which covers most claims a player could bring. Do not read the figure below as a limit on your consumer rights: your right to delivery, to a working service, to a refund and to compensation under mandatory law is not capped by anything in these Terms.
Where a cap is permitted, our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim, with a maximum of EUR 500 per customer.
Exceptions - We ARE Liable For
Belgian law does NOT permit exclusion of liability for:
- Fraud or intentional misconduct
- Gross negligence
- Personal injury or death caused by negligence
- Violations of mandatory consumer protection rights
Article 11: Governing Law and Jurisdiction
Applicable Law: Belgian law, specifically:
- Belgian Civil Code
- Belgian Code of Economic Law Book VI
- EU Consumer Rights Directive 2011/83/EU
- EU Digital Content Directive 2019/770
- EU Payment Services Directive 2 (PSD2)
Jurisdiction: Disputes go to whichever court is competent under the mandatory consumer rules that apply to you — for most consumers, a court in the country where you live. Where those rules leave the choice open, the courts of Brussels, Belgium are competent, because that is where we are established.
EU Consumer Protection: If you are a consumer in another EU member state:
- You retain the right to bring claims in your home country's courts
- Mandatory consumer protections of your jurisdiction may apply
No Waiver: Nothing in these Terms limits or waives mandatory consumer rights.
Article 12: Entire Agreement and Amendments
These Terms of Sale, together with our Terms of Service, Privacy Policy, and Community Guidelines, constitute the entire agreement regarding purchases.
No Verbal Modifications: No verbal statements by staff override these written Terms.
Amendment Procedure
- Updated version published on www.arkasa.gg
- Email notification to active customers at least 14 days in advance
- The amended Terms apply to purchases you make after they take effect
Changes that cost you more need your active agreement. A price increase, or any change that makes a running subscription worse for you, is never imposed by carrying on playing. We ask you to agree, and if you do not, you may cancel before the change takes effect and you keep your existing terms until then. Simply continuing to use the Server is treated as acceptance only for changes that are neutral or in your favour.
